| WHY: |
The success of today's products increasingly depends on features covered by patents. As more high-tech products are designed and manufactured throughout the world and exported to the U.S., courts in the U.S. and the U.S. International Trade Commission (ITC) are being used as the battlegrounds to decide which company can capitalize on innovations in the marketplace. To compete, companies must navigate around patents of other companies or use their own patents to protect their successful innovations. This requires an understanding of the litigation dynamics in U.S. courts and at the ITC.
Patent claim interpretation proceedings, otherwise known as "Markman hearings," the performance of company witnesses, and discovery are the most important aspects of virtually every patent case. To win, it is important to know what to do and what to avoid when preparing and conducting Markman hearings, preparing witnesses to testify, and participating in discovery. This workshop will focus on these aspects of a patent litigation |
