New Developments in China Affecting Trademarks and Franchising

On September 26, 2005, China’s State Administration for Industry and Commerce announced new rules for reviewing trademark registration applications and resolving trademark disputes. The new rules amend the 1995 Rule No. 37 governing China’s Trademark Review and Adjudication Board ("TRAB"), the equivalent of the USPTO’s Trademark Trial and Appeal Board. The major changes are addressed in the e-Alert.
