A New Day For Franchising In China

Since 1997, China has had trial or interim regulations for the administration of domestic franchise operations. In order to meet the World Trade Organization’s requirements that most restrictions on foreign investments be lifted by December 11, 2004, China’s Ministry of Commerce (“MOFCOM”) promulgated new franchise regulations on December 30, 2004, known as Measures for the Regulation of Commercial Franchises (“Franchise Measures”). The Franchise Measures became effective on February 1, 2005, and replaced the trial or interim regulations.
