11-05-2008 Sonnenschein Achieves Victory for Lessee in New York Appellate Division
On October 21, Sonnenschein achieved a victory in the New York Appellate Division, First Department, for its client 40 East 80 Apartment Corp., the lessee under a  99-year ground lease. The dispute concerned the interpretation of the lease’s periodic rent adjustment clause. The Appellate Division upheld our client’s position that the rent adjustment clause did not permit consideration of air rights applicable to the adjoining parcel owned by the landlord even though the client’s apartment building actually utilized those adjacent air rights and notwithstanding the landlord’s argument that the air rights must be considered because they pertain to a single zoning lot under the New York City Zoning Resolution. This favorable decision will save the client many millions of dollars in rental payments over the remaining term of the ground lease.  This case was handled by Marty Schwartz.
10-10-2008 Sonnenschein Argues Landmark Patient Referral Law Case to Maryland's Highest Court
On October 10, 2008, the Maryland Court of Appeals—the State's highest court—heard oral argument in a case being watched by medical practices as well as state and national medical associations across the country. In Potomac Valley Orthopaedic Association et al. v. Maryland State Board of Physicians et al., Sonnenschein appellate litigators represent 12 petitioner medical practices that are challenging the Maryland State Board of Physicians' declaratory ruling that prohibits non-radiology medical practices from providing their patients with in-office magnetic resonance imaging (MRI) and computed tomography (CT) services. 09-19-2008 Sonnenschein Represents Insurance Client Before the California Court of Appeals
In State of California v. Continental Insurance Company, et al., No. E041425 (Cal. Ct. App.), members of Sonnenschein's appellate subgroup, Paul Glad and Katie Evans, are representing an insurance company client in an appeal that could have important ramifications for insurance companies throughout the State of California.

09-19-2008 Sonnenschein Represents ABA as Amicus Curiae In Title IX Case in U.S. Supreme Court
In one of the most important civil rights cases of the Supreme Court's coming Term, the American Bar Association called upon Sonnenschein attorneys to represent the ABA, as amicus curiae, to argue that Title IX of the Education Amendments of 1972 does not preclude claims under Section 1983 to vindicate rights under the Equal Protection Clause of the Fourteenth Amendment.

09-10-2008 Sonnenschein Forges New Standards in Bankruptcy Law in Key Win Before the Eighth Circuit
In PW Enterprises, Inc. v. North Dakota Racing Commission, ___ F.3d ___, 2008 WL 3981809 (8th Cir. Aug. 29, 2008), Sonnenschein appellate lawyers in the bankruptcy group, Robert Millner and Chris Prince, won an important victory in a Chapter 7 bankruptcy case pending before the United States Court of Appeals for the Eighth Circuit.

08-22-2008 Sonnenschein Successfully Represents Medis Technologies, Ltd. in Class Action Complaint
Sonnenschein attorneys Deborah Renner, Reid Ashinoff and Ben Delfin in New York, and Christopher King in Chicago, along with paralegal Patrice Ho Sang in New York, successfully represented Medis Technologies, Ltd. and other defendants in a securities fraud class action which alleged that Medis had made misleading statements concerning its portable power source product, a liquid fuel cell "Power Pack."  Only one month after hearing argument on defendants' motion to dismiss the complaint for failure to plead scienter (i.e., an intent to deceive), Judge Paul Crotty of the United States District Court for the Southern District of New York granted the defendants' motion in its entirety, without leave to replead, noting "there are very real evidentiary shortcomings undermining the allegations."
