Health Care Litigation

Over the past 10 years, the U.S. Department of Justice (DOJ), regional U.S. Attorneys’ Offices, and State Attorneys General increasingly have directed their resources to health care fraud enforcement under a variety of civil and criminal statutes and regulations, including Federal and State false claims, anti-kickback, and physician self-referral laws, as well as the Federal Medicaid Drug Rebate and Prescription Drug Marketing Acts. 

Sonnenschein’s health care litigators are experts in helping a wide variety of health care entities respond to such law enforcement efforts.

Sonnenschein's national health care practice includes a diverse, talented team of attorneys who have extensive public sector experience in prosecuting companies and individuals involved in some of the most noteworthy health care fraud cases over the past decade.  Our health care litigation team also includes a number of attorneys with decades of private sector experience helping sophisticated health care entities, including providers, suppliers, manufacturers, practitioners and payers, address the substantial risks posed by government investigations and administrative, civil and criminal litigation.  For example:

  • The Firm’s health care litigators regularly conduct internal corporate investigations and audits, provide representation in HHS voluntary self-disclosure proceedings, and ensure corporate compliance with State and Federal administrative subpoenas and authorized investigative demands.
  • Our litigators also defend health care entities in complex civil litigation brought under the Federal civil False Claims Act, involving, for example, the Medicare Secondary Payer statute, the Prescription Drug Marketing Act, the Medicaid Drug Rebate Program, and Federal and State anti-kickback statutes. 
  • In addition, the Firm represents clients in other complex civil litigation matters involving commercial disputes.  Among other things, our litigators have defended clients against class action litigation involving Medicare pharmaceutical pricing issues, assisted health care entities with antitrust disputes, and sued to protect client assets, such as valuable commercial licensing agreements.
