Dealing with Problems

Forensic Investigations/Asset Recovery
Our attorneys have significant experience in conducting internal investigations for a variety of firm clients, including Tribal clients.  We have conducted investigations involving inappropriate investments, unfair business terms, potential kickbacks, and inappropriate conduct by employees, advisors and even legal counsel. In conducting investigations, we typically work closely with accountants and other outside advisers.

On behalf of one Tribe concerned about possible malfeasance by a gaming contractor it had terminated, we worked in conjunction with investigators and accountants to conduct a comprehensive financial audit of Tribal government and casino finances.  Our attorneys have reviewed large investment portfolios to identify and investigate suspicious transactions and cost-effectively pursue claims against insiders, advisors and third parties.

Litigation
More than half of our lawyers practice various aspects of litigation, representing clients in courts throughout the nation, as well as before state and federal regulatory agencies, arbitrators and in other forums.

We represent Tribes and Tribal officials in state and federal court at both the trial and appellate levels. To that end, we have secured dismissal of a variety of disputes ranging from contract litigation and membership disputes directed at Tribes and their officials, to the resounding defeat of environmental litigation challenging Tribal economic development projects.

We also have represented Tribes and Tribal members in the pursuit of actual (and possible) litigation in which they are seeking affirmative relief and redress for harm caused them by third parties, typically by local government officials.
