Regulatory Enforcement and Litigation

Our experience includes:
  • AAA arbitrations on behalf of major wireless carriers against a Regional Bell Operating Company (RBOC) seeking reimbursement of payments for tariffed SS7 messaging charges that violate the Telecommunications Act of 1996 and the parties’ interconnection agreements.
  • Defense of a national wireless carrier in a federal court action brought by a RBOC to recover intercarrier compensation charges.
  • Interconnection arbitration and enforcement proceedings before state regulatory commissions for several competitive local exchange carriers.
  • Representing wireless carriers and CLECs in interconnection and intercarrier compensation disputes with incumbent local exchange carriers, including trial of complex cost, network, and traffic exchange issues.
  • Negotiation of complex licensing agreements to develop email, web navigation, and IM-to-SMS capabilities for wireless handsets.
  • Representing wireless carriers in state commission and federal court proceedings involving preemption of state regulation of rates, billing, and quality of service.
  • Handling state commission investigations and federal court preemption litigation on behalf of a national cable provider, arising out of state attempts to regulate VoIP services.
  • FCC petition for a declaratory ruling seeking access to unbundled incumbent telephone company dedicated transport on behalf of a major wireless company.
  • Patent litigation and representation in indemnification claims on behalf of a major U.S. wireless company arising out of claims relating to the sale of wireless telephone handsets and wireless internet access.
