Hospitals & Health Systems
Sonnenschein’s Health Care Practice Group represents dozens of hospitals and health systems nationwide on a wide-range of legal issues. Our clients include multi-facility health systems, large urban health centers, and smaller community hospitals. Many of our hospital clients are religiously-sponsored nonprofit entities, while others operate on a for-profit basis, including some companies that focus on the development and/or management of hospitals specializing in a specific area, such as rehabilitation hospitals. On behalf of hospital and health system clients, Sonnenschein provides a variety of services. For example:
- The Firm regularly counsels hospitals of all types with respect to Medicare, Medicaid, and other Federal and State health care programs. This advice covers provider certification, conditions of participation, provider contracting, coverage, billing, reimbursement, EMTALA requirements, and related issues.
- Sonnenschein attorneys help hospitals ensure that their various business arrangements, contracts, marketing initiatives and investment strategies comply with Federal and State anti-kickback, physician self-referral, reassignment, fee-splitting, beneficiary inducement, and related laws and regulations. The Firm has conducted internal investigations, audits and risk assessments of coverage, billing, coding, reimbursement and documentation policies and procedures, and advised, when appropriate, on disclosure and repayment obligations.
- The Firm handles sophisticated transactions on behalf of its hospital clients, including mergers, divestitures, stock and asset acquisitions, affiliations, joint operating agreements, joint venture arrangements and more common health care contracting matters.
- Sonnenschein attorneys have extensive experience advising hospitals and health systems on the HIPAA privacy, security and other administrative simplification standards, as well as applicable State law privacy laws and regulations.
- Sonnenschein attorneys defend hospitals in connection with administrative, civil and criminal audits, investigations and litigation, including actions alleging improper coding, billing, pricing, and reimbursement, as well as actions involving alleged violations of Federal and State anti-kickback, physician self-referral, and related laws and regulations.
- In conjunction with the Firm’s Public Law & Policy Strategies Group, Health Care Practice Group attorneys help clients proactively influence decisions of Congress, the Administration, and Federal and State agencies by monitoring, evaluating, initiating and responding to legislative, regulatory and policy actions and decisions.
