Health Information Technology & E-Health

Sonnenschein does extensive work in both the health information technology (HIT) and e-health areas.  Unlike other technology companies, HIT and e-health companies are required to comply both with corporate, securities, intellectual property, and related laws and regulations and with Federal and State health care laws and regulations, including anti-kickback, physician self-referral, and patient privacy laws. 

Sonnenschein’s Health Care Practice Group, working with attorneys in the Firm’s multidisciplinary e-business group, creates innovative solutions to the complex business and regulatory issues facing both start-up and established HIT and e-health companies.  For example:

  • Our attorneys represent HIT and e-health companies, as well as traditional health care providers, with respect to strategic alliances and joint ventures with third-party technology companies, including arrangements that involve the outsourcing of business functions such as Web site maintenance and application development. 
  • The Firm advises clients with respect to entering into teaming agreements to jointly market and sell existing e-health products and services.
  • Sonnenschein attorneys advise clients concerning the protection of intellectual property on the Web, advertising issues, content liability issues (as publisher and as bulletin board), encryption issues, and technology transfer issues.
  • Firm attorneys advise clients with respect to the enforcement of proprietary and intellectual property rights on the Internet, including protecting against trade disparagement, theft of trade secrets, and computer piracy.
