SOLID AND HAZARDOUS WASTE
The management and generation of hazardous waste is regulated by both the federal and state governments. In addition, counties and cities often have their own requirements. Sonnenschein lawyers across the country are familiar with federal, state and local laws and regularly assist clients with the proper storage, transportation, recycling, and disposal of solid and hazardous wastes. In addition to assisting clients in enforcement and penalty actions, our lawyers also have developed numerous hazardous waste management plans, to help ensure compliance with state and federal laws.
Sonnenschein lawyers have helped clients, including generators and transporters, comply with virtually every aspect of RCRA and state hazardous waste laws. We have:
- Obtained Subtitle C and Subtitle D TSD (treatment, storage and disposal) permits.
- Successfully litigated administration challenges to hazardous waste management permits.
- Defended criminal allegations related to hazardous waste operations and characterization.
- Advised officers of hazardous waste management concerns with respect to personal liability issues.
- Advised management in the stock auction of a publicly traded hazardous waste management company and in the reorganization of another hazardous waste management company.
- Advised numerous clients with respect to the regulatory coverage of various "recycled' materials.
- Worked with county agencies to ensure compliance in the transportation of hazardous waste from retail facilities in California.
- Assisted clients in the facility closure process and the corrective action permitting process.
- Developed an environmental compliance manual to ensure the proper management of solid and hazardous wastes.
- Assisted clients with the proper characterization, reuse and recycling of hazardous wastes.
- Successfully litigated administration challenges to Part B permits and defended criminal allegations related to hazardous waste operations and characterization.

NUCLEAR AND RADIOACTIVE WASTE MANAGEMENT
Our waste management disposal expertise extends to nuclear wastes ranging from high-level nuclear waste, low-level nuclear waste, 11e.(2) of the Atomic Energy Act, transuranic waste, FUSRAP and evaluation of radioactive wastes exempted by the Nuclear Regulatory Commission (NRC). We have worked with and litigated with or against the NRC on regulated nuclear waste disposal facility licensing issues, including license termination and closure plans. We have appeared before the Northwest Interstate Compact on Low-Level Radioactive Waste regarding waste disposal in the region, and been involved in licensing, leasing, closure and perpetual care and maintenance issues with disposal facilities in Washington and Utah. We have worked with the Department of Energy's Waste Isolation Pilot Plant in New Mexico, and advised Department of Energy contractors or contract bidders of radioactive and mixed radioactive and hazardous waste issues for the Fernald Facility, Ohio, and Harford Reservation in Richland, Washington.
