Sonnenschein successfully defended pro bono client Friendly Temple Missionary Baptist Church in an action brought against the church for conversion by the seller of certain real and personal property.
Throughout the course of a number of discovery disputes, the plaintiff refused to provide any meaningful discovery to our client in violation of their obligations under Missouri rules and court order. After repeatedly asserting our client's entitlement to full written discovery and depositions, we moved to dismiss the seller's claim against our client as a discovery sanction (a sanction rarely imposed by the Missouri courts).
Rich Finneran argued the dispute in the Circuit Court of St. Louis City. Judge Dowd sustained our client's motion and dismissed the case with prejudice. The client was thrilled and very thankful for the Firm's work on the matter. Rodney Boyd also contributed to the representation.
