As more and more states require insurers to look beyond the “four corners” of the complaint in analyzing whether there is a duty to defend, what problems and opportunities do unpleaded facts present? What type of investigation must an insurer conduct for facts that might create a “potential” for coverage? How should insurers reconcile unpleaded facts that contradict the lawsuit’s allegations?
